Tenement Law Reform

On 25th April 2024, the Scottish Law Commission (SLC) published its Discussion Paper consulting on reform of the law of the tenement. To help shape the recommendations  for their final report, the SLC is pleased to accept comments from anyone with an interest in this subject up until the closing date of 1st August 2024.

This particular Discussion Paper focuses on the subject of compulsory owners’ associations for tenement buildings as, over the years, a lack of maintenance and improvement works to the fabric of these buildings has left many tenements in a state of disrepair. The Scottish Parliament Working Group, which was convened in March 2018 to explore what could be done to improve the condition of the country’s tenements, therefore made a number of recommendations for changes in legislation and practice, one of which being that all tenement buildings should have an owners’ association to coordinate work to their building.
